LEGAL DISCLAIMER & STATUTORY CONSUMER NOTICES

1. Australian Consumer Law (ACL) Mandatory Notice

Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law (ACL), Schedule 2 of the Competition and Consumer Act 2010 (Cth).

For major failures with the service, you are entitled:

  • to cancel your service contract with us; and
  • to a refund for the unused portion, or to compensation for its reduced value.

You are also entitled to choose a refund or replacement for major failures with goods. If a failure with the goods or a service does not amount to a major failure, you are entitled to have the failure rectified in a reasonable time. If this is not done, you are entitled to a refund for the goods and to cancel the contract for the service and obtain a refund of any unused portion. You are also entitled to be compensated for any other reasonably foreseeable loss or damage from a failure in the goods or service.

Nothing on this website or in our Terms of Service excludes, restricts, or modifies any consumer right, remedy, or statutory guarantee conferred by the ACL that cannot lawfully be excluded.

2. Delivery Timeframe & Third-Party Carrier Disclaimer

  • Estimated Timeframes: Any shipping timeframes quoted on this website (including our 5–10 business day standard delivery estimate) are provided in good faith as reasonable estimates based on standard air freight schedules and historical Australia Post performance. They do not constitute guaranteed delivery deadlines unless explicitly agreed in writing.
  • Events Outside Our Control (Force Majeure): Findo is not liable for transit delays caused by circumstances beyond our reasonable operational control, including but not limited to severe weather conditions, international flight cancellations, border force customs clearance delays, state quarantine holds, carrier network disruptions, industrial action, or peak seasonal carrier backlogs (e.g., Black Friday, Christmas, Boxing Day).
  • Risk of Loss: Title and risk of loss for products pass to you upon delivery by Australia Post to the specified shipping address or designated safe drop location.

3. GPS Positioning, Cellular Network & Environmental Limitations

  • Operational Dependencies: The Findo pet tracking device relies on active global positioning satellite (GPS) signals, cellular data transmission (4G/LTE mobile networks across Australia), and companion software infrastructure. Accuracy, update frequency, and signal coverage are inherently subject to external geographical and environmental variables.
  • Coverage Exclusions: Tracking capabilities may be limited, degraded, or temporarily unavailable in remote outback zones, underground structures, dense forests, steep terrains, metallic enclosures, or regions lacking compatible cellular tower coverage. Findo does not warrant uninterrupted, error-free, or 100% continuous pinpoint tracking in all geographical areas across Australia.
  • Not a Substitute for Enclosure or Supervision: Findo tracking hardware is sold strictly as a lifestyle monitoring, safety aid, and recovery-assistance device. It does not replace physical fencing, secure leashing, professional animal containment, or active parental/owner supervision. To the maximum extent permitted by Australian law, Findo accepts no liability for injury, death, loss, or third-party damage resulting from pet wandering, escape, or behavioral incidents.

4. Battery Performance & Operational Life Disclaimer

Battery performance metrics (such as standby time and active tracking hours) referenced on our marketing pages are derived from controlled testing environments under standard battery-saver profiles. Actual battery consumption will vary depending on network signal strength, live tracking refresh intervals, ambient operating temperatures (e.g., extreme Australian summer heat), and pet movement patterns.

5. Limitation of Liability

To the fullest extent permitted by the laws of Australia and the relevant State or Territory:

  • Findo, its directors, officers, employees, and affiliates shall not be liable for any indirect, incidental, punitive, special, or consequential damages, including loss of data, loss of profits, emotional distress, or veterinary medical costs arising out of the use or inability to use the device or companion mobile application.
  • In circumstances where the Australian Consumer Law permits limitation of liability for breach of a non-excludable guarantee, our total aggregate liability is strictly limited, at our sole option, to: (a) the replacement of the goods or the supply of equivalent goods; (b) the repair of the goods; (c) the payment of the cost of replacing the goods or acquiring equivalent goods; or (d) the payment of the cost of having the goods repaired.

6. Governing Law & Jurisdiction

These terms, policies, and all transactions conducted via Findo are governed by and construed in accordance with the laws in force in the Commonwealth of Australia. Any disputes arising in connection with these terms shall be submitted to the non-exclusive jurisdiction of the courts of Australia.
